1a. Lessee and “additional driver(s)” only, as mentioned in the rental agreement, are authorized to drive the vehicle. Lessee and “additional driver(s)” must be 23 years or older.

1b. If an accident occurs and the driver is not the Lessee or “additional driver(s)”, the insurance becomes invalid and the Lessee will be held fully responsible for all direct and indirect damages/losses.

2a. If CDW (Collision Damage Waiver) is accepted, the deductible for damages to the rental vehicle is: $500 for cars, and $1,000 for Jeeps, SUV’s and Vans. The CDW covers the rental vehicle for damages in case of a collision. CDW does not cover the following situations: “One-way” accidents, driving under the influence of alcohol or drugs, speeding, off-road driving and damages to third parties exceeding $85,000 (damages beyond the covered $85,000 are at the renter’s expense). A valid police or ForenSys report of the accident must be presented to our company. If not, the CDW becomes invalid and the Lessee will be held responsible for the total amount of damages/losses. In case CDW is not accepted, the Lessee will be held responsible for the total amount of damages/losses.

2b. If Theft insurance is accepted, the damages incurred during theft or joyriding of the rental vehicle have a deductible of $500 for cars and $1,000 for Jeeps, SUV’s and Vans. A valid police report of theft or joyriding and the car key must be presented to our company. If not, the theft insurance becomes invalid and the Lessee will be held responsible for the total amount of damages/losses. If theft insurance is not accepted, the Lessee will be held responsible for the total amount of damages/losses caused by the acts of theft or joyriding.

2c. If Full Insurance is accepted, the Lessee is covered for all damages/losses caused by collisions, theft, joyriding and “one-way” accidents. The deductible for damages/losses to the rental vehicle is $100. Full Insurance does not cover the following situations: Driving under the influence of alcohol or drugs, speeding and off-road driving. If the full insurance is accepted, damages to third parties are covered up to $85,000 (damages beyond the covered $85,000 are at the renter’s expense). A valid police or ForenSys report of the damages and/or losses must be presented to our company. If not, the full insurance becomes invalid and the Lessee will be held responsible for the total amount of damages/losses.

3. Damages and losses are charged as follows: Gas cap: $50 - Hub cap: $65 (or dealer price) - Beach Chair: $50 - Wheel wrench: $30 - Jack: $80 - Jack handle: $20 - Antenna: $40 - Ice Jug: $80 - Radio: dealer’s price - Car key: $20 - Key with chip: $200 - Key with chip/remote: dealer price - Car tire: $200 - SUV’s/Van tire: $250 - Jeep tire: $300 - Car rim: dealer price - Snorkeling Gear: $50 Battery car: $100 - Battery Jeep/SUV/Van: $250 - Jeep soft top: dealer price - Jeep hard top: dealer price - Jeep/SUV’s/Van rim: $170 (alu. rim: dealer price).

4a. SMOKING, IN ANY FORM, IS NOT PERMITTED WITHIN THE VEHICLE. In violation of this term, lessee will incur a $100 cleaning fee.

4b. KEY WITH CHIP/REMOTE IS NOT PERMITTED IN WATER. Driving off-road, on white sand, dunes or in the ocean, is not permitted. Any damages/losses to the vehicle due to off-road driving or driving on white sand, dunes or in the ocean are for Lessee’s account.

5. The car must be returned with the same quantity of liters of gasoline as received. If failed to do so, the charge per 1/8 tank of gasoline is US$18 for cars and US$25 for Jeeps/SUV’s/Vans. In case that the vehicle is delivered with more gasoline than received, the additional gasoline is non-refundable

6. In case of an accident, ForenSys must be called by dialing 165 and our main office (during office hours 8 AM – 6 PM), phone #(297) 587-1729. A ForenSys report must always be filled out.

7. In case of a flat tire, call Top Drive directly during office hours or road service after 6 pm (available 24/7). To replace exploded tires, prices are as follows: Car tire: $200 - SUV’s/Van tire: $250 - Jeep tire: $300

8. Vehicle must be returned to the place of pick-up. Should there be any changes in time, date or place; we must be notified at our (main) office, phone (297) 587-1729.

9. Vehicle must be returned clean and in the same conditions as received. In case of excessive dirt or wet seats, Top Drive will charge the Lessee for any cleaning, repair/replacement, and time loss costs. Cleaning fees are as follows: In case of wet seats, a $50 cleaning fee will be charged - In case of deep cleaning, a $100 cleaning charge fee will be charged. Top Drive is not responsible for any personal belongings left in the car.

10. In case a soft top Jeep is rented, the top must be closed overnight and during rain showers. If not, the Lessee will be held responsible for any kind of (interior) electro damages that may occur to the vehicle.

11. Vehicles might be equipped with telematics.

12. It is strictly forbidden to remove or dismantle doors, seats, radio, antenna, soft top, hardtop, stickers etc.

13. The Lessee is at all times, directly responsible for all damages/losses to the rental vehicle, including water damage. Lessee is responsible to pay for any damages incurred during the rental period prior to leaving the island.

14a. Lessee will give Top Drive Car Rental a power of attorney to use, if necessary, any provided credit card or company card, to pay these damages/losses.

14b. Only Aruban law shall be applicable to this rental agreement.

15a. A mandatory amount of $300 up to $500 subject to changes, will be held as security deposit, and returned to the Lessee after rental agreement has closed. Return of the security deposit may take up to 30 business days, subject to international banking regulations.

15b. Only credit cards are accepted for security deposit. Debit cards are not accepted (all mentioned charges/prices are excl. tax).

Términos y Condiciones - Spanish

1a. Exclusivamente el arrendatario y el/los "conductor(es) adicional(es)", como mencionados en el contrato de alquiler, estarán autorizados para conducir el vehículo. El arrendatario y el/los "conductor(es) adicional" debe ser de 23 años o mayor.

1b. Si ocurre un accidente, y el conductor no es el arrendatario o el/los "conductor(es) adicional(es)", el seguro será inválido y el arrendatario será considerado completamente responsable por todos los daños/pérdidas directos e indirectos.

2a. Si se acepta el 'CDW' (seguro de colisión), el monto por daños ocasionados al vehículo de alquiler será de: US $500 por autos y US $1.000 por Jeeps, SUV’s y Vans. El CDW cubre el vehículo de alquiler por daños en caso de una colisión. El CDW no cubre las siguientes situaciones: Accidentes de "dirección obligatoria", conducir bajo la influencia de alcohol o drogas, exceso de velocidad, conducir fuera de camino y daños ocasionados a terceras partes que sobrepasen US $85.000 (Daños después de los $85,000 corren por cuenta del arrendatario). Deberá entregarse un informe policial válido del accidente a nuestra compañía. Si no, el CDW será inválido y el arrendatario será considerado responsable del importe total de los daños/pérdidas. Si no se acepta el CDW, el arrendatario será considerado responsable del importe total de los daños/pérdidas.

2b. Si se acepta el seguro contra robo, el monto por daños ocasionados durante la pérdida del vehículo de alquiler tendrá un deducible de: US $500 por autos, y US $1.000 por Jeeps/SUV’s/Vans. Deberá entregarse un informe policial válido del robo y/o los daños y la llave del vehículo a nuestra compañía. Si no, el seguro contra robo será inválido y el arrendatario será considerado responsable del importe total de los daños/pérdidas. Si no se acepta seguro contra robo, el arrendatario será considerado responsable del importe total de los daños/pérdidas ocasionados por los actos de robo y joyriding.

2c. Si se acepta seguro completo, el arrendatario tendrá cobertura por todos los daños/pérdidas ocasionados por accidentes, robo, joyriding y accidentes de "dirección obligatoria". El monto por daños/ pérdidas ocasionadas al vehículo de alquiler tendrá un deducible de: US$100. El seguro completo no cubre las siguientes situaciones: conducir bajo la influencia del alcohol o de las drogas, exceso de velocidad, y conducir fuera de camino. Si se acepta el seguro completo, los daños a terceros están cubiertos hasta $50,000 (los daños mas allá de los $50,000 son a cargo del arrendatario). Deberá entregarse un informe policial válido de los daños y/o pérdidas a nuestra compañía. Si no, el seguro completo será inválido y el arrendatario será considerado responsable del importe total de los daños/pérdidas.

3. Los daños y pérdidas se cobran de la siguiente manera: Tapa de gas: $50 - Tapa de cubo: $65 (o precio de agencia) - Silla de playa: $50 - Llaves de rueda: $30 - Gato $80 - Asidero del gato: $20 - Antena: $40 - Contenedor de hielo: $80 - Radio: precio de agencia - Llave de carro: $20 - Llave con chip: $200 - Llave con chip/remoto: precio del agencia - Llanta de coche: $200 - Llanta de SUV’s/Van: $250 - Llanta de Jeep: $300 - Rim de coche: precio de agencia (llanta de aluminio, precio del agencia) - Equipo de snorkel: $50 - Batería de carro: $100 - Batería Jeep/SUV/Van $250 - Jeep soft top: precio del agencia - Jeep duro superior: precio de agencia - Llantas de Jeep/SUV's/Van: $170 (alum. llanta, precio de agencia).

4a. FUMAR, DE CUALQUIER FORMA, NO ESTA PERMITIDO DENTRO DEL VEHICULO.En violación de este término, el arrendatario incurrirá $100 en cargos de limpieza extensiva.

4b. LLAVE CON CHIP/REMOTO NO ESTA PERMITIDA EN EL AGUA. No se permite conducir fuera de la carretera, en arena blanca, dunas o en el océano. Cualquier daño al vehículo debido al manejo en todo terreno, arena blanca, o en el océano es por cuenta del arrendatario.

5. El vehículo tiene que ser devuelto con el mismo monto de litros de gasolina que se recibió. Si no se hace, las cargas adicionales por 1/8 tanque de gasolina es de $18 para carros y $25 para Jeeps/SUV’s/Vans. En caso retornar el vehículo con más combustible de lo acordado, no hay ningún reembolso.

6. En caso de un accidente, por favor llame al servicio de carretera por teléfono marcando # 165 y a nuestra oficina principal (entre 8 AM – 6 PM) al teléfono # (267) 587-1729. Un informe de Forensys del accidente debe ser llenado obligatoriamente.

7. En caso de pinchazo (llanta baja) llame a Top Drive directamente durante el horario de oficina o al servicio de carretera después de las 6pm (disponible 24/7). Reemplazar llantas/neumáticos explotados, los precios son los siguientes: Llanta de coche: $200 - Llanta de SUV’s/Van: $250 - Llanta de Jeep: $300

8. El vehículo debe ser devuelto donde fue recogido. Si hay cualquier cambio acerca de horario, la fecha o el lugar de retorno, debe ser notificado a nuestra oficina principal al teléfono #(297) 587-1729.

9. Deberá entregarse el vehículo limpio en el mismo estado en que lo recibió. En caso de suciedad excesiva, Top Drive podrá cargar cualquier gasto de limpieza y/o reparación/reemplazo a cuenta del arrendatario. Las tarifas de limpieza son las siguientes: en caso de asientos mojados, se cobrará una tarifa de limpieza de $50 – En caso de limpieza profunda, se cobrará una tarifa de limpieza de $100. Top Drive no se hace responsable de ninguna pertenencia personal que sea dejada en el vehículo.

10. En caso de alquilar un Jeep con cubierta de lona, la cubierta debe cerrarse durante la noche y durante las lluvias. En caso contrario, el arrendatario será responsable de cualquier tipo de daños eléctricos (interiores) que puedan ocurrir en el vehículo.

11. Los vehículos pueden estar equipados con telemática.

12. Esta estrictamente prohibido retirar o desmontar puertas, asientos, radio, antena, capota blanda, capota rígida, pegantes (stickers), etc.

13. El cliente siempre es directamente responsable a Top Drive Car Rental para todo tipo de daños, incluyendo el daño de agua para vehículos convertibles. El cliente declara pagar estos daños antes de salir de la isla.

14a. Cuando el cliente es responsable de los daños, el/ella le concede a Top Drive Car Rental el poder para utilizar cualquier tarjeta de crédito o tarjeta de compañía entregado para así para pagar los daños ocasionados.

14b. Solo la ley de Aruba será aplicable a este contrato de alquiler.

15a. Una cantidad obligatoria de $300 a $500, sujeto a cambios, se mantendrá como depósito de seguridad, y se devolverá al Arrendatario después de que el contrato de alquiler haya terminado. La devolución del depósito de seguridad puede tardar hasta 30 días, sujeto a las regulaciones bancarias internacionales.

15b. Solo se aceptan tarjetas de crédito para el depósito de seguridad. No se permiten tarjetas de débito. te
